OMG Heidi! holy crap. Is he ok? wow. I sincerely hope he is ok and not hurting at all. the article says that they are considering charges - why? it would seem
to me that it was a simple accident and that could not be avoided.

Yes, thank God, he is going to be okay. He suffered a lacerated scalp (to the bone), two broken ribs, and a lacerated spleen - all on the left side which
obviously occured when the cab rolled over onto the driver's side. He's also got many assorted cuts and bruises. He was able to get out of it on his
own but he ended up collapsing not too far from it. Thankfully it didn't blow up or else he would have been killed by the explosion.
Charges are pending because no one stopped to verify his account of what happened. This happened at 4:30 in the morning in some small town 20 miles southwest of Daytona Beach so there was probably not much traffic. In fact, he was lying there for several minutes before someone came along and called 911 for him. And they didn't stick around, probably because they were afraid of a possible explosion. So he laid there alone until emergency personnel came for him. I think they'll probably cite him with wreckless driving, take points off of his license and hit him with a fine - how much I have no idea. Also, I'm sure he's going to be fired once he's released from the hosptial. But he's alive and he's going to be okay so that's the main thing. He's in a hospital in Daytona Beach because they had the nearest trauma center. Unfortunately, that's 3 hours northeast of here. I was there with him this weekend but had to come back for work today. Of course, I wouldn't have done that had he been in critical condition but they moved him to a regular room Saturday afternoon so I felt confident that I could leave. They're going to try to get him up out of bed for little bit today and he was finally able to go off the liquid diet. So yeah, it's been a lot of fun. When I was driving up to Daytona on Friday afternoon (because I didn't even find out about this until hours and hours later - he wouldn't let them call me!), I actually passed the accident scene and saw the tanker still lying there like a big dead dinosaur. It freaked me out to think that he had been inside that thing while it rolled over. Thank God he had his seat belt on - yes, they do save lives. I would love to receive your prayers and good wishes for a speedy recovery - his broken ribs are giving him the most pain right now. And also please pray that he doesn't lose his job. Thanks guys.

A lawyer would probably tell you that if there is no evidence of what they want to charge him with, then the prosecutor has nothing. They can't prove a negative without evidence. It's absurd. I hope you can find out what they are really thinking. I hope you have a lawyer or that his insurance will provide him with one. But more than anything, I hope he is okay. What a horrible accident. I'm sure this was really hard to hear about, especially with everything you have going on right now. Please let us know if there is anything we can do to help or offer support.

Karen: no one else was hurt in the accident so I would guess he's just going to get a ticket for wreckless driving. When they say "charges" it
sounds so ominous. This is a workman's comp claim; would they actually provide a lawyer for him? Because we can't afford one on our own. Hopefully, it
won't be an issue.
Yes, it was hard to hear about - especially since the ER left a message on my work phone and I didn't get to it right away. Talk about your blood running cold... ABC: the company he works for has fired every other employee who has rolled a tanker so I expect this to happen to him, too. After all, he ruined a $100K tanker and his company will have to foot the bill for the clean-up. If it was up to his immediate boss, he probably wouldn't be fired - he actually came to see my husband on Friday afternoon after having been at the accident scen all day; he seemed pretty shook up. But it's not up to my husband's boss but rather their Corporate offices. The only thing he's got going for him is his pristine driving record up until now. He's won many safety awards and has gotten many safety bonuses plus he's in their Million Mile Club, meaning that he's driven over a million miles for them so far. I just hope that they'll take this into consideration when making their decision.

absolutely, you and your family have my best wishes. Wow, scary is right. so the dude that was going much slower didn't even stop!?! he was the dummy that
caused the accident! I can also relate to hi not letting them call you....my dad did the same thing when he was hurt in an accident - hours later one of the
guys he works with called. God I was mad at him for that
I sincerely hope they don't fire him - is that even legal? I can see if he has had multiple accidents are being careless, but this was the case. thank god he's going to be ok. I hope he's able to come home real soon. .

OMG! That picture freaked me out. I'm so happy he's ok. Firing him doesn't seem fair to me. He has a good driving record, and it was an accident!

WOW! No need to ask, yes I will keep you all in my prayers. Thank God he's ok. I do have a question-seeing all the fuel surrounding the truck, and knowing
he made his way away from it, is he in danger from the prolonged exposure to the fuel? How horrifying, for him, and for you.

Dar: yes, it's legal to fire him for this - Florida is an employment-at-will state; you can basically be fired for almost anything. Phoebe: the white stuff surrounding the tanker was actually the flame-retardent foam they spray all over so that it hopefully won't explode. But yes, he did have diesel fuel raining down upon him as he was trying to extricate himself from the cab. I don't know what kind of long-term effects that could have on him but he's always getting fuel spilled on him in the course of his job. I would guess that long-term exposure could cause cancer of some type - or not - he seems to have a guardian angel on his side!

Well Heidi - they would be doing the WRONG thing if they let him go. Yes, the truck was expensive, and yes it WAS an ACCIDENT. That is why those companies
have insurance! You cannot put a price tag on someone's life!!

Lord he is lucky - guardian angel is right! I didn't realize there was other pictures on the link as well....how incredible! The good thing is that diesel
is not as explosive as gasoline, but still very dangerous. I can't believe he will be fired for this, the truck must have been insured and they must have
insurance to cover the environmental clean up....that would never happen in Canada, unless there was neglect on the drivers part, which is not the case here. I
was thinking about him all night. Did they say how long he'll be in the hospital?

OMG Heidi. I am so thankful he escaped and is on the mend. Can they fire him in the US for accidents when it is his job to drive...they could not get away with
that in Canada...and if they do...I would fight it tooth and nail especially since he has all those safety citations. I agree with Erda. Without concrete
evidence or a positive DUI indication, they can't do anything.

There's no proof here that there was even a car in front of him despite the skid marks in the road that seem to indicate he braked for a reason. Also there are no witnesses to this to validate my husband's story so they've only got his word to go on. So if he gets charged with wreckless driving, he will be fired regardless of his prior excellent driving record. It doesn't seem like it now but maybe it's a blessing in disguise. If you read the comments some folks have made on the various articles on that news website, these people don't believe my husband at all - they're convinced he's at fault and he's lying about it because he doesn't want to get into trouble. They can't even consider that another driver might actually be at fault. Not one of them cares if he's okay or not. They might be interested to learn that my husband and other drivers like him deal with idiots on the highway every, single day but because they're professionals and very skilled at what they do, they are able to avoid having horrific accidents with these morons. People pull out in front of my husband's tanker all of the time; they inexplicably slow down while he's barrelling down at them at 60 miles and hour not realizing that he can't stop on a dime like a car can. They tailgate him, they flip him the bird, etc. He's gotta deal with all kinds of stupid crap from regular drivers and yet they have the nerve to blame him for this. Everyone keeps asking my husband why didn't he just run straight into the car instead of trying to avoid it; ironically, he would have probably fared a whole lot better had he done so. But of course my husband didn't want to kill that fool and have it on his conscience for the rest of his life. Besides, if his company thinks this is expensive now, just imagine the law suit settlement that jerk's family would have gotten had Ron plowed into that car on purpose. THEN everyone would say that he should have sacrificed himself! Anyway, we still don't know if he's going to be fired. I'm sure they're waiting to drop that bomb until after he gets out of the hospital so I would guess we'll know some time this week. I do know that the corporate offices are going over his records with a fine tooth comb so it appears as though they're looking for reasons to justify booting him.

Heidi, my dad was a long haul driver for 30 years, the entire time I was growing up, he was away all week, he drove for a contruction company hauling
construction equipment - I can relate to the idiot drivers that pull out in front of these trucks - believe me. People do not get it, these trucks simply
cannot stop on a dime. I didn't read the comments, but I can just imagine the unjust things that are being said. Don't let him take it to heart, he did
what he had to do to avoid killing someone, simple as that.

Heidi - at the risk of sounding flippant on this - I will take it.
If your husband loses his job over this - life will go on - he was AMAZINGLY lucky to walk away from this terrible incident - he did not kill anyone in the process and you still have your husband and father to your children. If his company would be so callous as to fire him for SAVING a life and wrecking a piece of equipment - then he does not need to work there - they do not deserve him. His full speedy recovery is all that matters, I woud hope his employer would feel the same. He did a very brave act, and it could have cost him his life.....shame on that company.

Yes, I agree that my husband is lucky to be alive and to have survived this accident with what have turned out to be relatively minor injuries. He could have died or ended up a quadraplegic. I've also told him that if they want to fire him after 13 years of loyal service and an exemplary safety record, then they can go to hell and for him not to worry about it, we'll get it figured out somehow. So far, they haven't fired him but they might be waiting until he gets out of the hospital to give him the bad news. Well, he gets discharged tomorrow so I guess we'll be finding out pretty soon. Perhaps they're waiting for the results of the tox screen to come back - I would think they would be back by now though since blood and urine were taken from him on Friday for this test. Regardless, he's the big moneymaker in our family and it's going to be quite painful for a while to do without his salary until he can find another job. I just have to wonder what kind of job he'll be able to get now that he's got this rollover on his record.

problem in Texas, too. It's really hard to press a case for discrimination or some other wrongdoing by a manager, or just that you are being fired because
they don't like your personal beliefs.
The blogs can get really ugly, and people say crap all the time without knowing what really happened or that a driver caused the accident or knowing anything about this industry. I'm afraid you'll have to ignore them unless you want to take a chance and anonymously post a defense of truck drivers. I'd give good consideration of that. I hope it all works for all of you, especially with the economy the way it is right now. BTW, I just heard some really good news at the school today: my son's teacher's husband works for a large plastics plant nearby. She said they finally have orders rolling in again after eight months of zilch. Edited to finish my post: Anyway, maybe things are starting to pick up a little bit again. Maybe some credit is being extended again to allow for orders, etc. Stay positive, and come here if you need to chat about it! (Big hugs to you and gentle ones to your dear hubby.
